The move follows a lawsuit from the U. S. Department of Justice that accused the Food and Drug Administration of failing to include in the Food and Drug Administration product labeling a warning that the drug could cause heart attacks and strokes in some patients.
The FDA has said it believes the labeling is inadequate and that its approval of Viagra, a generic version of the drug, is based on evidence that the FDA has not adequately assessed its safety and efficacy, the lawsuit alleged.
The lawsuit, filed in U. District Court in Southern District of Texas, alleged that the agency failed to properly evaluate the label and evaluate its warnings about the cardiovascular risks of the drug.
The agency said it did not have enough data to make a determination regarding whether the drug could cause heart attacks or strokes, and said it did not consider the data available to it.
In a ruling, the FDA said it had determined that the agency has the authority to decide whether the drug is safe and effective for a particular patient.

“The FDA’s failure to adequately consider the safety and efficacy of this drug and its label is a violation of the Federal Food, Drug, and Cosmetic Act (FDCA), and the Federal Trade Commission Act (FTCA),” the FDA said.
